HELD. - Harrison, a black, had standing to challenge the exclusion of Hispanic-surnamed prospective jurors. Harrisons constitutional objection to jury membership was timely, though not raised until after the jury was sworn. The facts did not sufficiently indicate racial bias in challenging prospective jurors. A claim of gender bias in jury selection would not be considered because it was not raised below. Exclusion of certain evidence as irrelevant was harmless error. The court did not err in excluding evidence claimed to be of a witnesss prior inconsistent statement, where the statement was not shown to be inconsistent. Search of the diaper bag was permissible as a search incident to arrest. The prosecutor erred harmlessly in commenting on the marital evidentiary privilege, and did not err in commenting on Harrisons silence in certain respects. The instruction on reasonable doubt was proper.
